DOJ Cyber Fraud Initiative - Cyber Faces the FCA Hammer

In late 2021, the Department of Justice announced a new initiative to combat misrepresentations about cybersecurity preparedness and control measures by federal contractors. As part of the Cyber Initiative, DOJ has brought actions under the False Claims Act (FCA). The use of FCA creates the possibility of whistleblower actions and the potential for significant liability. Join us to examine the Cyber Initiative, discuss actions under FCA, including qui tam actions, look at FCA actions in the government contracting and healthcare contexts, and consider ways to mitigate risks of being in the DOJ's crosshairs.
